1. Scope
These terms of service apply to the use of the Poem Diary app and all related services. By using the app, you accept these terms.

3. Service Description
Poem Diary offers:
- AI-generated poems based on your photos
- Wide selection of poet styles from various countries and eras
- Automatic saving with date and location – your personal poetry diary
- Personal notes for each poem
- Share poems via email, WhatsApp, or social media
- Offline access to saved poems
- Multi-device synchronization when signed in with Apple ID
4. Content Usage Rights
Your Images: You retain all rights to the images you upload. Images are stored in our cloud storage and used only for poem generation and display in the app.
Generated Poems: You may freely use, share, and publish the generated poems for personal purposes.
No Exclusive Rights: Since the poems are generated by AI, we cannot guarantee exclusive rights to the outputs. Similar results from similar inputs are possible.
5. Free Usage
Try for Free: You can explore the app for free. After signing in with your Apple ID, you receive 3 free poems to try.
Sign-in Required: To generate poems, signing in with Apple ID is required.
After Free Poems: Once your free poems are used up, you need a subscription to create more poems.
6. Subscription & Credit Packs
Poem Diary offers three subscription models with a generous poem allowance per billing period:
Weekly Subscription: Automatic weekly renewal.
Monthly Subscription: Automatic monthly renewal.
Yearly Subscription: Automatic yearly renewal — the most affordable subscription option.
Credit Packs: Subscribers can purchase additional credits as a one-time purchase (10, 50, or 100 credits). Credits are automatically used once the regular allowance in the current billing period is exhausted. An active subscription is required to use credits. Unused credits do not expire.
Billing: Billing is handled through Apple. The current prices for your country can be found directly in the app.
Cancellation: Subscriptions can be cancelled at any time in iOS Settings under 'Subscriptions'. The subscription remains active until the end of the paid period.
The exact number of included poems is displayed in the app. After the billing period expires, the allowance is automatically reset.
7. Usage Policy
Poem Diary is intended for personal, non-commercial use. The provider reserves the right to restrict access in cases of abusive or automated usage. For questions, please contact admin@poemdiary.com.
8. Usage Restrictions
It is prohibited to:
- Upload content that violates applicable law
- Use copyrighted works without authorization
- Create offensive, discriminatory, or violence-glorifying content
- Abuse or overload the app infrastructure
- Circumvent or manipulate security mechanisms
9. AI-Generated Content
The poems are generated by artificial intelligence (Claude by Anthropic). Please note:
- The poems are created in the style of the chosen poet. They are inspired by their writing style and expression, but are not works by the poet themselves – they are independent AI creations.
- We cannot guarantee the quality, originality, or factual accuracy of the generated texts.
- Coincidental similarities with existing works are possible.
- You should review the generated content yourself before publishing.
10. Disclaimer
Availability: The app is provided 'as is'. We make no guarantees regarding uninterrupted availability or error-free operation.
Limitation of Liability: Liability is limited to intent and gross negligence.
Data Loss: For local storage without sign-in, we assume no liability for data loss due to device change, uninstallation, or technical problems.
11. Termination and Account Deletion
Delete Account: You can delete your account at any time in the app under 'Profile'.
Data Deletion: When deleting your account, all your data is permanently deleted. Details can be found in our Privacy Policy.
Subscription Cancellation: An existing subscription must be cancelled separately in iOS Settings. Account deletion does not automatically end the subscription.
Suspension: We reserve the right to suspend or delete accounts that violate these terms.
12. Final Provisions
Changes: We reserve the right to change these terms of service. Changes will be announced in the app. Continued use constitutes acceptance of the modified terms.
Applicable Law: German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
Jurisdiction: The place of jurisdiction, to the extent legally permissible, is Bonn.
Severability Clause: If individual provisions of these terms of service are invalid, the validity of the remaining provisions remains unaffected.
